NABC 2020 International Short Film Festival

Rules and Regulations

A. Description

  1. The North American Bengali Conference 2020 (hereinafter referred to as the “NABC”), is the 40th Uttar America Banga Sammelan cultural conference organized by the Cultural Association of Bengal (hereinafter referred to as the “CAB”), a Trust Foundation having its registered address at 141 Grymes Hill Road, Staten Island, New York 10301, USA, along with Partner Organizations to be held at The Westgate Resort, Las Vegas, USA from 3rd to 5th July, 2020.

  2. These rules and regulations (hereinafter referred to as “Rules and Regulations”) apply to NABC 2020 International Short Film Festival (hereinafter referred to as “Festival” being apart of the North American Bengali Conference 2020) having its office at 35, Chittaranjan Avenue, 1st Floor, Kolkata - 700012, West Bengal, India.

  3. By entering and participating in the Festival, you agree to be bound by these Rules and Regulations.


B. Eligibility

  1. Participation in the Festival is open for all, including students and professionals alike. Any filmmaker desirous of participating in the Festival (hereinafter referred to as “Participant”) should be 18 years and above.

  2. Those participants under the age of 18 must provide a consent letter duly signed by their respective parents/guardian.

  3. The last day for submission of all short films (hereinafter referred to as “Content”) for the Festival is 30th April 2020. All entries not received by the NABC, Kolkata Office address as enlisted in the Entry Form annexedherein, before the said date shall not be eligible for participating in the Festival.

  4. The members of the NABC 2020 International Short Film Festival Organizing and Selection Committee, members of the Jury or their family members, relatives or any other person personally know to such memberare not allowed to engage in the Festival as Participant.

  5. All content used in the short film, including story, write-up, script, depiction, music, graphics, photographs, images, screenplay, sound records, lyrics, background scores, dialogues, titles, sub titles and all other literary, dramatic, musical and artistic work or any other copyright material therein, should be original and belonging to the Participant or licensed to Participant under a valid license.

  6. The Participant must obtain all necessary licenses, permissions, certifications and authorization and has complied with all applicable laws necessary for participating in the Festival.

  7. If any copyrighted material is used in the film, the participant must have the permission and submit a copy to the Festival Organizers.

  8. All Short Film submissions produced only after 1st April 2019 is eligible for the Festival.

  9. Each Participant shall be eligible to send one or more entry.

  10. The NABC reserves the right to disqualify any person that it knows is, or has reasonable grounds to believe is, ineligible for the Festival.

  11. Participants shall retain all ownership rights of their content and submission.


C. Submission

  1. The Content that is submitted must be the participants’ original work and shall not infringe on any copyrights or any other rights of any third parties.

  2. The Content can be based on any subject, concept or theme. NOTE: NABC 2020 Short Film Festivalisnot accepting Animated Short Filmand/or Documentary.

  3. The entirecontent should have a minimum run-time of 3 minutes but should not exceed 20 minutes in duration, excluding titlesand credits. Participants must ensure that the titles and credits displayed do not last for more than 1 minute.

  4. The Participant shall participate in the Festival by submitting the entry form available online on or before the last date of submission by submitting a printed copy of the entry form generated online duly completed with accurate and current information along with 2 (TWO) DVD copies containing the content to the address duly enlisted on the Entry Form by hand or by courier or by registered post, such that the printed form and content reached the enlisted address of NABC on or before the said deadline.

  5. The file format of the content submission must be in BluRay format onlystored in DVD. Any content submitted in any other format shall be rejected.

  6. In case a Participant submits multiple entries, each entry alongwith the content and printed form shall be submitted separately i.e. only one short film on one DVD with separate entry form.

  7. YouTube or any other micro-site links shall not fall under consideration for participation and/or selection.

  8. The content submitted must bein Bengali language only and must be submitted along with English subtitles or can have no dialogues at all.

  9. The Entry Fee is INR 1000 (Rupees One Thousand Only) percontent submission.

  10. Student participants may avail a discounted entry fee of 750 INR (Rupees Seven Hundred and Fifty Only) only upon production of a valid Student Identity document.

  11. In case of multiple entries from the same participant each film must be accompanied by a separate form and entry fee.

  12. Participant shall not submit the short film content in multiple parts or on more than one DVD. The DVD submitted should be labeled with the title of the film besides being accompanied by the printed form. Participants are requested to avoid sticking paper on the DVD.

  13. Participant shall be solely responsible for packing, safety and timely delivery of the short film content at the address specified. The NABC is not responsible for late, lost, damaged, misdirected, postage due, stolen, or misappropriated entries.

  14. DVDs submitted for selection will be considered as final and no changes will be entertained after submission. It is the sole responsibility of the applicant to submit DVDs without any physical / quality defects.

  15. Entry Forms with incorrect / inadequate / illegible / ambiguous / incomplete particulars will not be considered. The NABC reserves the right to accept or refuse any film without assigning any reason whatsoever.

  16. The Short Film Contents that are selected for final screening shall not be allowed to withdraw under any circumstances until the Festival is over.


E. Award Categories

The categories for awards under the Festival shall be as follows:

  1. Best Film

  2. Second Best Film

  3. Best Director

  4. Best Screenplay

  5. Best Cinematography

  6. Best Editing

  7. Best Creative Concept

  8. Best Sound

  9. Best Music Composition


F. Gratification

  1. The winner of each category specified above, shall be gratified at the main event organized by NABC. Date and time shall be duly notified on the NABC website and micro-sites.

  2. Award shall not be convertible to cash, transferable or assignable. Substitution of award by winner shall not be entertained.

  3. Affidavits of winners less than 18 years of age at time of award must be countersigned by parent or legal guardian. Affidavits are subject to verification by the NABC 2020 International Short Film Festival.


G. Selection & Judging

  1. All the entries received by NABC on or before the date specified, complying with these Rules and Regulations shall be screened to the editorial team of NABC. Selective short films from and amongst all the content entries received shall be shortlisted by the editorial team of NABC for final screening at the Festival.

  2. The shortlisted short films shall then be screened by a panel of jury members atth Festival consisting of renowned personalities from the world of film and art, industry professionals consisting of independent producers, production companies, filmmakers, and other film industry professionals who shall be appointed with discretion by NABC.

  3. The selection and number of judges of the Festival shall be at NABC’s sole discretion. The decision of NABC and the judges at all stages of the Festival shall be final and binding on the Participants. No enquiries, complaints, disputes or appeals shall be entertained in this regard. The Participant shall accept and abide by any and all decisions made by NABC and the panel of judges without limitation, decisions relating to the Festival, selection of winners and the criteria for selection of winners.

  4. The jury appointed for judging the Festival shall be disclosed on website prior to the commencement of judging of the short films.

  5. The Short-listed content to be screened at the Festival shall be published the on website

  6. The jury members shall declare winners from within the shortlisted entries:

    1. 1 (one) Best Film

    2. 1 (one) Second Best Film

    3. 1 (one) Best Director

    4. 1 (one) Best Screenplay

    5. 1 (one) Best Cinematography

    6. 1 (one) Best Editing

    7. 1 (one) Best Creative Concept

    8. 1 (one) Best Sound

    9. 1 (one) Best Music Composition


  7. All films shall be judged based on:

    1. Original Content (Story and Script)

    2. Production (Camera Work, Lighting, Shot Composition)

    3. Post- Production (Editing, Transitions, Pacing, Continuity, Flow)

    4. Image (Focus, Color, Lighting)

    5. Sound Quality (Clarity, Consistency of Audio Levels, Lack of Noise)


  8. The Participant shall not make unauthorized contact with any members of the Jury or try to influence the decisions of jury or any other act of such kind. NABC reserves the right to disqualify any Participant indulging in such acts.

  9. The NABC shall reserve the Right to Screen the submitted content (maximum 6 screenings) in different cities of India / USA on non-commercial basis. NABC also reserves the right to use excerpts of any content thus submitted to the Festival on television network / Internet Media platforms, micro-sites during the duration of the Festival for promotional / publicity purposes only.

  10. The NABC reserves the right to extend the Festival deadline for any unforeseen reasons.


H. Terms and Conditions

  1. The participation in the Festival is entirely voluntary and it shall be deemed to have been made on a voluntary basis.

  2. By entering the Festival, the participant agrees that the NABC shall not be held liable for any copyright infringements perpetrated by the participant.

  3. NABC shall post all announcements, changes or updates on the website and on the social media pages of the Festival - Facebook, Twitter and Instagram. All communication selection, short-list and winners of the Festival shall be communicated to the participants by email.

  4. All deadlines for submission of application forms and content are strictly enforced and must be adhered to by the Participant.

  5. Participant expressly agrees and confirms that NABC shall have worldwide rights in perpetuity for promotional and archival purposes. Participation constitutes permission to use winner's name, likeness and voice for future advertising and publicity purposes without additional compensation.

    NOTE: that the short film submissions shall not be issued, circulated, broadcasted, assigned, sub-licensed, reproduced, telecasted, transmitted and communicated to the public or any copies of the short film to any person, in any form, format, medium with anyone or uploaded online without the prior permission of the participant.

  6. All submitted DVDs submitted by the participant shall become the property of NABC and are not returnable

  7. Failure by NABC to enforce any of its rights at any stage does not constitute a waiver of those rights.

  8. Furnishing any false information or concealment of any material facts in the application form will result in immediate disqualification of the Participant.

  9. Any filmmaker, institution or organization is strictly not allowed to use the name The NABC 2020 International Short Film Festival, the Festival Logo and/or the Official Selection laurel for any commercial, non-commercial, cultural or personal use without the prior permission of the NABC.

  10. NABC reserves the right to withdraw or alter the terms of the Festival without prior notice. No correspondence in this regard shall be entertained. All changes shall be posted on the website and micro-sites. It is the responsibility of the Participants to keep themselves informed as to any changes to the Rules and Regulations of the Festival.

  11. The Participant represents and warrants that he or she is not under any contract with any person, firm, corporation or authority that would prevent his/her participation in the Festival and displays of short film or any other matter connected therewith and agrees to indemnify NABC against any claim that may be brought against it in this regard or any loss that may be caused due to it.

  12. The Participant understands and accepts that he or she shall not copy or use ideas of third party or another Participant at any stage in the Festival. The Participant accepts that he or she has not infringed upon and shall not infringe upon the copyright or other intellectual property right of any other person by creating and submitting the short film.

  13. The Participant ensures and acknowledges that the Participant is the author of, or the owner or licensee of the copyright in the story, write-up, script, depiction, music, graphics, photographs, images, screenplay, sound recording, lyrics, background scores, dialogues, titles, subtitles and other literary, dramatic, musical or artistic works used while creating and developing the short film, and that it has not been copied in any manner from any source whatsoever and has full right to participate in the Festival, receive award and permit NABC to upload, exhibit, display the content as stated in these Rules and Regulations.

  14. NABC reserves the right in its absolute discretion to disqualify any Participant at any stage if it has reasonable grounds to believe that a Participant has breached any of the Rules and Regulations, any applicable law (including copyright law) or has otherwise infringed the intellectual property rights of any other person. Each Participant acknowledges and agrees that any failure to comply with the Rules and Regulations could lead to NABC disqualifying the Participants, without NABC giving any reason for such disqualification or granting any opportunity for challenge.

  15. NABC reserves the right to reject or remove any short film entry submitted which is obscene, defamatory, libelous, abusive, harassing, tortuous, discriminatory, intimidating, vulgar, pornographic, profane, threatening, invasive of privacy or publicity rights or otherwise objectionable, or unlawful subject matter or which constitute or encourage a criminal offence, violate the rights of any party or otherwise gives rise to liability or violates any law, in its absolute discretion.

  16. The Participant agrees and undertakes not to engage in any press, publicity or other discussion with any third party in connection with their entry forms or their participation in the Festival or any other aspect of the Festival, before, during or after the Festival, without obtaining prior written approval of NABC.

  17. NABC assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or jumbled, scrambled transmission, communications line failure, theft, destruction, or unauthorized access to the social media site, website of NABC or program or programming error or failure, or failure to capture any entry information. NABC and its Sponsors shall not be responsible for injury or damage caused to the Participant’s or to any other person, relating to or resulting from participation in the Festival.

  18. NABC is not responsible for any problems with or technical malfunction of any telephone or internet network, or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the internet or at any website, human errors of any kind, or any combination thereof.

  19. The Participant shall not have any claim against NABC or its organizers or its sponsors in case of cancellation or postponement of the Festival.

  20. By participating in the Festival, all Participants agree to release, discharge, hold harmless and indemnify NABC and its organizers, sponsors, partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, liabilities, costs, debts, expenses (including but not limited to attorney’s fees) and damages arising out of their (i) participation in the Festival or any Festival related activities; (ii) use of and access to the websites for the Festival; (iii) any violation of any third party right including without limitation any copyright, property or privacy right; (iv) the acceptance and use, misuse, or possession of any award awarded hereunder (v) breach of representations, or any of these Rules and Regulations. This indemnification obligation will survive these Rules and Regulations and the Participant’s participation in the Festival.

  21. Participant acknowledges that in case any of the terms of these Rules and Regulations is deemed invalid or becomes unenforceable or prohibited by applicable law, such portions shall be considered divisible and shall not be considered part of the consideration, and the remainder of these Rules and Regulations shall be valid and binding and of like effect as though such provision was not included herein.

  22. The Rules and Regulations, and any dispute or claim arising out of or in connection with them or their subject matter including the Festival, existence, negotiation, validity, termination or enforceability shall be governed by and construed in accordance with applicable laws of India.

  23. The Courts of Calcutta shall have exclusive jurisdiction in relation to any and all dispute or claim arising out of or in connection with the Rules and Regulations.
